Como en el Vaticano, donde se espera el humo blanco (\u201cfumata bianca\u201d) que indica que se ha elegido un nuevo Papa, los contribuyentes esperaban nuevas respuestas. Sin embargo, como tambi\u00e9n sucede cuando aun no hay nuevo sucesor de Pedro, el humo sali\u00f3 negro (\u201cfumata nera\u201d), esto es, no hubo una decisi\u00f3n sobre el particular<\/p>\n\n\n\n<p>Quiz\u00e1 la consulta fue demasiado amplia por lo que ayudar\u00eda mucho fraccionar el problema en varias preguntas alusivas a una norma particular de la Ley del Impuesto a la Renta (LIR), pues de acuerdo con el art\u00edculo 93 del C\u00f3digo Tributario, las consultas institucionales a la SUNAT deben versar sobre el sentido y alcance de las normas tributarias. Como dicen ante un proyecto muy grande es mejor <strong>\u201ccomer el elefante a pedacitos\u201d<\/strong>. En este contexto, planteamos <strong>5 preguntas<\/strong> que quiz\u00e1 ayuden a iluminar un sector econ\u00f3mico que sigue generando riqueza (o p\u00e9rdidas tambi\u00e9n) sin mayor control:<\/p>\n\n\n\n<ol class=\"wp-block-list\" type=\"1\"><li>\u00bfLa enajenaci\u00f3n de criptomonedas por personas naturales sin negocio genera una ganancia de capital gravada seg\u00fan el inciso b) del art\u00edculo 1 y el art\u00edculo 2 de la LIR?<\/li><li>\u00bfLa enajenaci\u00f3n de criptomonedas de manera habitual por personas naturales constituye renta empresarial de acuerdo con el numeral 3 del segundo p\u00e1rrafo del art\u00edculo 1 y el inciso a) del art\u00edculo 28 de la LIR?<\/li><li>\u00bfEn general cuales son los criterios para considerar que existe habitualidad en la venta, cambio o disposici\u00f3n de bienes, esto es, cu\u00e1l es el alcance de la habitualidad dispuesta en el numeral 3 del segundo p\u00e1rrafo del art\u00edculo 1 y el inciso a) del art\u00edculo 28 de la LIR?<\/li><li>\u00bfDe acuerdo con el art\u00edculo 32 de la LIR cu\u00e1l ser\u00eda el valor de mercado en la enajenaci\u00f3n de criptomonedas realizada por una empresa?<\/li><li>\u00bfLa obtenci\u00f3n de criptomonedas originadas en el minado bajo el procedimiento de prueba de trabajo es ingreso gravado de acuerdo con el art\u00edculo 1, el art\u00edculo 28 y el art\u00edculo 57 de la LIR?<\/li><\/ol>\n\n\n\n<p>Mientras la SUNAT se anima, el mercado no se detiene y requiere algunas repuestas. Hace algunos a\u00f1os dimos una charla en BINANCE sobre el particular y dejamos algunos criterios que creo que colaboran en esclarecer la materia <strong>(1)<\/strong> .
